Every item listed on Pickle must be authentic. Counterfeit, replica, "dupe," and other non-authentic branded items are not permitted. An item may only reference, display, or be listed under a brand if it is an authentic item produced or authorized by that brand.
What is not allowed
The following are prohibited on Pickle:
Counterfeit items: items that bear or imitate a brand's name, logo, trademark, or protected design without the brand's authorization, or that are made to appear genuine when they are not.
Partially genuine items that combine authentic components with counterfeit parts, or that have been altered to appear to be from a brand.
Misleading proof of authenticity: using or providing receipts, authenticity cards, packaging, serial numbers, product images, or other materials to suggest an item is genuine when it is not.
Misrepresentation through pricing: pricing a non-authentic item at or near the value of the genuine item in a way that implies it is authentic.
Inconsistent representation: describing an item one way in the listing and another way in messages (for example, listed as authentic but admitted as a replica, or the reverse).
Relisting an item that has been removed as inauthentic.
What is allowed
Authentic branded items. Genuine items produced or authorized by the brand, listed under that brand.
Genuinely unbranded items. Original items that carry no brand name, logo, or trademark and are not made to imitate a specific brand's product. These must be listed as Unbranded and may not reference a brand as their inspiration or use a brand's trademark anywhere in the listing. Describing an item's general style or era ("1990s slip dress," "minimalist leather tote") is fine; naming a brand it imitates is not.
Seller responsibility
Sellers are responsible for knowing whether an item is authentic before listing it. Pickle may, at any time, require a seller to provide proof of authenticity for any listed item, and may remove or restrict items pending that proof. A seller's lack of knowledge around an item’s authenticity does not prevent Pickle from refunding the renter or buyer, removing the listing, or restricting the account.
Renter and buyer protection
When an item is found to be counterfeit or is not authentic as represented, the renter or buyer may be eligible for a full refund. The seller may forfeit any earnings from the transaction and may be responsible for related costs incurred by Pickle.
Enforcement
Pickle may remove or correct any listing that violates this policy and may cancel or reverse any related transaction. Depending on the circumstances, Pickle may take one or more of the following actions:
Remove the listing (removed items may not be relisted).
Require the seller to provide proof of authenticity.
Issue a formal policy warning.
Restrict the seller from listing branded or designer items.
Temporarily suspend selling, renting, payouts, or account access.
Review or remove the seller's other listings.
Permanently suspend the seller's account.
Pickle may permanently suspend an account after repeated violations. Pickle may also permanently suspend an account after a single violation where there is evidence of intentional deception, fabricated proof of authenticity, multiple misrepresented items, re-listing after removal, or other serious fraudulent conduct.
